Targeted employment areas and Florida investments

The reduced $800,000 minimum applies to an investment in a targeted employment area or an infrastructure project. USCIS defines a targeted employment area, at the time of investment, as a rural area or an area with unemployment of at least 150% of the national average rate (USCIS). Each project’s qualification is set out in its own offering and its Form I-956F filing, so families review it with their immigration counsel project by project.

How the EB-5 timetable meets your South Florida move

An EB-5 petition, a school place and a Florida home each run on their own calendar. The Le Strand Landing Plan places them in one dated sequence, built around what the family needs.

  • The home. The Landing Plan maps renting on arrival and buying a home side by side, against the timetable your counsel sets, with your tax adviser on the purchase.
  • School entry. Miami-Dade, Broward and Palm Beach start their 2026-27 school year between 10 and 13 August, and Florida uses 1 September as the age date for kindergarten and grade one (Le Strand school-year guide, checked 31 October 2026). The Landing Plan dates the family’s arrival around that start.
  • Source-of-funds records. USCIS asks investors to evidence that the capital was lawfully obtained; the regulation lists records such as business registrations and personal and business tax returns filed within five years (8 CFR 204.6(j)(3)).

Frequently asked questions

How many EB-5 regional centers are approved in Florida?

As of 1 November 2026, the USCIS data file lists 56 regional centers able to operate in Florida; 23 are approved for Florida only and 33 also cover other states. Florida ranks 6th of the 55 states and territories (USCIS data file).

What is the EB-5 minimum investment for a Florida project?

The same national figures apply: $1,050,000, or $800,000 in a targeted employment area or an infrastructure project, for petitions filed on or after 15 March 2022. Both amounts adjust from 1 January 2027 (8 U.S.C. 1153(b)(5)(C)).

Which family members does an EB-5 investment cover?

USCIS states that EB-5 investors “(and their spouses and unmarried children under 21) are eligible to apply for lawful permanent residence” (USCIS). Under the Child Status Protection Act, a child’s age is the age on the date a visa becomes available minus the time the petition was pending, and the child stays unmarried to qualify (USCIS, CSPA).

We are moving to Miami. What does EB-5 mean for our family’s move?

An EB-5 investment can bring green cards for the investor, a spouse and unmarried children under 21 (USCIS). USCIS lists regional center approval by state rather than by city; as of 1 November 2026, 56 centers are approved to operate in Florida, and each offering states its own project location. The Landing Plan then dates the home, the school start and the arrival against the EB-5 timetable your counsel sets.

Our children will start school in Palm Beach County. How does that fit the EB-5 timetable?

Palm Beach, Miami-Dade and Broward start the 2026-27 school year between 10 and 13 August, and Florida uses 1 September as the age date for kindergarten and grade one (Le Strand school-year guide, checked 31 October 2026). The Landing Plan places that start alongside the I-526E, green card and I-829 steps on one dated calendar.

Are there EB-5 regional centers in Boca Raton?

USCIS lists regional centers by the state they are approved for, and Boca Raton is in Palm Beach County, Florida. As of 1 November 2026, 56 centers are approved to operate in Florida. Each project’s location is set out in its offering documents and its Form I-956F filing, and your counsel confirms that it sits within the center’s approved area.

When does the South Florida school year start?

Miami-Dade, Broward and Palm Beach start the 2026-27 year between 10 and 13 August, and Florida uses 1 September as the kindergarten and grade one age date (Le Strand school-year guide).

Where can I check a Florida regional center’s current status?

On the USCIS approved list and the USCIS terminations list, by name or USCIS ID. Le Strand records each change between editions on the changelog.

Who EB-5 covers, and the green card sequence

USCIS states that EB-5 investors “(and their spouses and unmarried children under 21) are eligible to apply for lawful permanent residence” (USCIS). The Child Status Protection Act protects a child’s age: USCIS takes the child’s age on the date a visa becomes available and subtracts the time the investor’s petition was pending, and the child stays unmarried to qualify (USCIS, CSPA). For applications filed on or after 15 August 2025, USCIS uses the Visa Bulletin’s Final Action Dates chart for this calculation (USCIS Policy Manual).

  1. Form I-526E. The investor files the petition through a regional center’s offering (USCIS, Form I-526E).
  2. Conditional green card. When a visa is available, the investor, spouse and children apply for permanent residence, in the United States or through a U.S. consulate. The green card is conditional, and its expiry date is the second anniversary of conditional residence (USCIS).
  3. Form I-829. The family files to remove the conditions during the 90 days before the conditional green card expires (USCIS, Form I-829).

Visa Bulletin, November 2026 (U.S. Department of State, final action dates, checked 1 November 2026): every EB-5 category is current for “All Chargeability Areas Except Those Listed”, Mexico and the Philippines. The rural, high-unemployment and infrastructure set-asides are current for every country; in the unreserved category the final action dates are 1 December 2016 for mainland China and 1 December 2023 for India (Visa Bulletin).
