The EB-5 minimum investment is $1,050,000, or $800,000 for a targeted employment area or an infrastructure project, for petitions filed on or after 15 March 2022. The statute adjusts both amounts for inflation from 1 January 2027, and DHS publishes the new figures in the Federal Register. On 1 November 2026, the current amounts apply (8 U.S.C. 1153(b)(5)(C)).

What the statute says about the 2027 adjustment
“Beginning on January 1, 2027, and every 5 years thereafter, the amount in clause (i) shall automatically adjust for petitions filed on or after the effective date of each adjustment, based on the cumulative annual percentage change in the unadjusted consumer price index for all urban consumers (all items; U.S. city average) reported by the Bureau of Labor Statistics between January 1, 2022, and the date of adjustment. The qualifying investment amounts shall be rounded down to the nearest $50,000. The Secretary of Homeland Security shall update such amounts by publication of a technical amendment in the Federal Register.”
“Beginning on January 1, 2027, and every 5 years thereafter, the amount in clause (ii) shall automatically adjust for petitions filed on or after the effective date of each adjustment, to be equal to 75 percent of the standard investment amount under subclause (I).”
How the adjustment works, step by step
- Start from the $1,050,000 standard amount.
- Apply the cumulative change in the unadjusted CPI-U (all items, U.S. city average) between 1 January 2022 and the date of adjustment.
- Round the result down to the nearest $50,000.
- Set the targeted employment area and infrastructure amount at 75% of the new standard amount.
- DHS publishes both figures as a technical amendment in the Federal Register; they apply to petitions filed on or after the effective date.
DHS’s proposed rule of 2 July 2026 restates this method and adds: “DHS will determine when finalizing this rule whether to include the adjusted amounts for petitions filed on or after January 1, 2027” (91 FR 40676). The statute measures the change in the CPI-U from 1 January 2022.
Total cost: the investment and the USCIS fees
A final rule sets new EB-5 filing fees for petitions postmarked on or after 30 November 2026 (91 FR 61940). For a regional center investor, the investment and the USCIS fees come together as follows.
| Item | Amount | Set by |
|---|---|---|
| Minimum investment | $800,000 (targeted employment area or infrastructure project) or $1,050,000 | 8 U.S.C. 1153(b)(5)(C); adjusts from 1 January 2027 |
| Form I-526E petition | $7,850, including the $75 EB-5 technology fee | USCIS fee rule |
| EB-5 Integrity Fund petition fee | $1,100 | USCIS fee rule |
| Form I-829, removing conditions | $5,000 | USCIS fee rule |
| USCIS fees for the investor’s two petitions | $13,950 in total | Sum of the three fees above |
| Regional center or offering fees | Stated in each offering’s documents | The offering |
| Green card applications for each family member | Listed on the USCIS fee schedule or by the Department of State | USCIS or the Department of State |

How to check a regional center against USCIS sources
These are the public checks families commonly take to their immigration counsel:
- Find the center by name or ID on the USCIS approved list, or on the Le Strand map, and confirm the state of the project is within its approved area.
- Search the USCIS terminations list for the same name and ID.
- Ask for the Form I-956F filing status of the specific offering: USCIS approves each investment offering separately.
- Ask counsel how the project qualifies for the investment amount offered (targeted employment area, infrastructure or standard).
- Agree with counsel how the planned filing date sits relative to 1 January 2027.
Frequently asked questions
What is the EB-5 minimum investment right now?
$1,050,000, or $800,000 for a targeted employment area or an infrastructure project, for petitions filed on or after 15 March 2022 (8 U.S.C. 1153(b)(5)(C)).
When does the EB-5 investment amount change?
The statute adjusts both amounts beginning on 1 January 2027, and every five years after that, for petitions filed on or after the effective date of each adjustment.
Where will the 2027 EB-5 investment amounts be published?
DHS publishes them as a technical amendment in the Federal Register. Status checked 1 November 2026: USCIS lists $1,050,000 and $800,000.
What does EB-5 cost in total?
For petitions postmarked on or after 30 November 2026: the investment ($800,000 or $1,050,000), plus USCIS fees of $7,850 for Form I-526E, $1,100 for the EB-5 Integrity Fund and $5,000 for Form I-829, $13,950 in total, plus any fees set by the offering (91 FR 61940).
How is the 2027 EB-5 amount calculated?

Which date decides whether the old or new EB-5 amount applies?
The statute applies each adjustment to petitions filed on or after its effective date. Immigration counsel confirms how that applies to a specific filing.
Who EB-5 covers, and the green card sequence
USCIS states that EB-5 investors “(and their spouses and unmarried children under 21) are eligible to apply for lawful permanent residence” (USCIS). The Child Status Protection Act protects a child’s age: USCIS takes the child’s age on the date a visa becomes available and subtracts the time the investor’s petition was pending, and the child stays unmarried to qualify (USCIS, CSPA). For applications filed on or after 15 August 2025, USCIS uses the Visa Bulletin’s Final Action Dates chart for this calculation (USCIS Policy Manual).
- Form I-526E. The investor files the petition through a regional center’s offering (USCIS, Form I-526E).
- Conditional green card. When a visa is available, the investor, spouse and children apply for permanent residence, in the United States or through a U.S. consulate. The green card is conditional, and its expiry date is the second anniversary of conditional residence (USCIS).
- Form I-829. The family files to remove the conditions during the 90 days before the conditional green card expires (USCIS, Form I-829).
Visa Bulletin, November 2026 (U.S. Department of State, final action dates, checked 1 November 2026): every EB-5 category is current for “All Chargeability Areas Except Those Listed”, Mexico and the Philippines. The rural, high-unemployment and infrastructure set-asides are current for every country; in the unreserved category the final action dates are 1 December 2016 for mainland China and 1 December 2023 for India (Visa Bulletin).
